Terms of Service

1. About this service

Assistant SENDCo is a web-based tool developed by Progress 55 Ltd that helps UK primary school teachers create SEN Support Plans following the graduated approach (Assess, Plan, Do, Review). By creating an account or using this service, you agree to these terms.

2. Who can use this service

This service is intended for use by:

• Teachers and SENDCos in UK primary schools
• School staff involved in creating or reviewing SEN Support Plans

You must be at least 18 years old to create an account. Accounts are for individual use — do not share your login credentials with others.

3. Your account

You are responsible for:

• Keeping your login credentials and encryption password secure
• All activity that occurs under your account
• Notifying us promptly if you suspect unauthorised access

We require multi-factor authentication (MFA) on all accounts. This is a security measure to protect the sensitive data you may enter.

5. Acceptable use

You agree to use this service only for its intended purpose — creating and managing SEN Support Plans for pupils in your school. You must not:

• Enter data for pupils who are not in your care or school
• Use the service for any purpose other than SEN support planning
• Attempt to access data belonging to other users
• Attempt to circumvent the security controls (encryption, MFA, RLS)
• Use automated scripts or bots to interact with the service
• Enter test or fictional data using real pupil names

6. AI features

Assistant SENDCo offers optional AI writing assistance. When you use these features:

• Anonymised text is sent to OpenAI for processing (pupil names are removed)
• You must review and accept or reject every AI suggestion before it is saved
• AI suggestions are a starting point, not professional advice
• You remain professionally responsible for the content of your plans

AI features require explicit consent each session. All plan features work fully without AI enabled.

7. Service availability

We aim to keep Assistant SENDCo available and reliable, but we do not guarantee uninterrupted access. The service may be temporarily unavailable for maintenance or due to circumstances beyond our control. We recommend exporting important plans as Word documents as a backup.

8. Limitation of liability

Assistant SENDCo is a tool to assist with SEN Support Plan writing. It does not replace professional judgement. Specifically:

• We do not assess, diagnose, or categorise pupils
• AI-generated suggestions are not educational or medical advice
• You are responsible for the accuracy and appropriateness of plan content
• We are not liable for decisions made based on content created using this tool

To the maximum extent permitted by law, Progress 55 Ltd's total liability to you for any claims arising from use of this service is limited to the amount you have paid for the service in the 12 months preceding the claim.

9. Termination

You may stop using the service and delete your account at any time from Settings. We may suspend or terminate your account if:

• You breach these terms
• We reasonably believe your account is being used fraudulently
• We are required to do so by law

If we discontinue the service, we will give at least 90 days' notice so you can export your data.

10. Changes to these terms

We may update these terms from time to time. If we make significant changes, we will notify you by email or through the service. Continued use of the service after changes take effect constitutes acceptance of the updated terms.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
